About this policy

This policy applies to personal information handled by Noosa Property Scout in the course of its business, including information handled in connection with obligations under the Privacy Act 1988 (Cth), the Australian Privacy Principles and the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth).

From 1 July 2026, certain services provided by real estate professionals, including buyer's agents, became regulated under the Anti-Money Laundering and Counter-Terrorism Financing regime. Where these obligations apply, Noosa Property Scout may need to collect, verify, use, retain and disclose personal information for customer due diligence, risk assessment, record keeping and reporting to AUSTRAC.

Personal information

Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable. Sensitive information is a category of personal information that includes information about matters such as health, racial or ethnic origin, political opinions, religious beliefs and criminal records.

Noosa Property Scout only collects sensitive information where it is reasonably necessary and you have consented, or where collection is otherwise permitted or required by law.

Information we may collect

The personal information collected depends on the enquiry, service and legal requirements involved. It may include:

• Name, date of birth, residential address and postal address
• Email address and telephone number
• Identification documents and information used to verify identity

How information is collected

Website analytics and cookies

The Noosa Property Scout website uses Google Analytics to understand how the website is found and used. Google Analytics may collect technical and usage information such as internet protocol address, browser type, device information, pages visited, time spent on the website, referring pages and approximate location information.

If information required for a service or legal obligation is not provided, Noosa Property Scout may be unable to proceed with an enquiry, provide the service or complete required customer due diligence.

When information may be disclosed

Personal information may be disclosed where reasonably necessary to:

• Selling agents, vendors and other parties involved in a property transaction
• Solicitors or law practices, lenders, accountants, inspectors and other professionals involved with your authority
• Contractors and service providers assisting with administration, technology, cloud storage, identity verification, compliance or professional services

• AUSTRAC, law enforcement bodies, regulators, courts, tribunals or government agencies where authorised or required by law
• Other recipients you authorise or where disclosure is otherwise permitted by law

Noosa Property Scout does not sell, rent or trade personal information for third party marketing.

Marketing communications

Noosa Property Scout may send service updates or property information where you have agreed to receive them or where otherwise permitted by law.

You can opt out at any time by using an unsubscribe link, replying to the communication or contacting Noosa Property Scout directly.

Security

Noosa Property Scout takes reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.

These steps may include access controls, secure systems, password protection, software updates, secure document handling and confidentiality requirements for contractors and service providers.

Access to personal information is limited to people who require it for an authorised business or legal purpose.

Retention and destruction

Personal information is retained for as long as reasonably necessary for the purpose for which it was collected and for any period required by law.

Anti-Money Laundering and Counter-Terrorism Financing records may need to be retained for periods prescribed by the applicable legislation and rules.

Complete copies of identity documents are not automatically required to be retained solely for Anti-Money Laundering and Counter-Terrorism Financing record keeping. Where a complete copy is no longer reasonably required, Noosa Property Scout will take reasonable steps to destroy it or make it no longer identifiable, subject to any other legal requirement.

Other personal information that is no longer required will be securely destroyed or made no longer identifiable where reasonable and permitted by law.

Overseas storage and processing

Noosa Property Scout uses Google Workspace for email, storage and document management and Google Analytics for website analytics. Personal information handled through these services may be stored or processed outside Australia, including in the United States and other locations where Google or its service providers operate.

The locations used by technology providers may change. Current information about Google's privacy practices and service providers is available through Google's published privacy and subprocessor information.

Noosa Property Scout takes reasonable steps when selecting and using service providers to protect personal information in accordance with applicable Australian privacy requirements.

Access and correction

You may request access to personal information held about you or ask for it to be corrected by contacting Noosa Property Scout.

Noosa Property Scout will respond within a reasonable period. Access or correction may be refused in circumstances permitted by law. Where required, reasons for the refusal and the available complaint options will be provided.

No fee will be charged for making a request. Reasonable costs may apply where permitted by law for providing access to information.

Privacy complaints

If you believe your personal information has not been handled appropriately, please contact Noosa Property Scout using the details below.

The complaint will be acknowledged, reviewed and responded to within a reasonable period. Further information may be requested where needed to investigate the matter.

If you are not satisfied with the response, you may lodge a complaint with the Office of the Australian Information Commissioner at oaic.gov.au.

Collection notices

A separate privacy collection notice will be provided where required when personal information is collected for customer due diligence or another particular purpose. The notice will explain the information required, why it is being collected, the legal authority for collection, the consequences of not providing it and the usual recipients of the information.

This policy should be read together with any collection notice provided at the time information is collected.

Policy updates

This policy may be updated when legal requirements, services or information handling practices change. The current version will remain available at noosapropertyscout.com.au/privacy.
